NOTICE IS HEREBY GIVEN that the resolution published herewith has been adopted for the Board of Fire Commissioners of the Danby Fire District, Tompkins County, New York on the 3rd day of January, 2008. Such resolution was adopted subject to mandatory referendum and such resolution was duly approved at the referendum held by the Fire District on February 12, 2008, and the validity of the obligations authorized by such resolution may be hereafter contested only if: (1) (a) such obligations were authorized for an object or purpose for which the Danby Fire District is not authorized to expend money or (b) if the provisions of law which should have been complied with as of the date of publication of this notice were not substantially complied with and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of publication of this notice; or (2) such obligations were authorized in violation of the provisions of the Constitution of New York. The following is a summary of a resolution adopted by the Board of Fire Commissioners of the Danby Fire District on January 3, 2008. Said resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of said serial bonds, in an amount not to exceed $870,000. The proceeds from the sale of the obligations authorized in said resolution shall be used for the specific purpose of financing the undertaking of a capital improvement project consisting of the reconstruction and construction of improvements of the existing firehouse headquarters located at 1780 Danby Road in the Town of Danby, New York, including the acquisition and installation of equipment, machinery and apparatus and any necessary site work for the foregoing purpose. The maximum estimated cost of this project is not to exceed $1,100,000. The plan of financing is (a) to issue a serial bond or bonds and a bond anticipation note or notes, and (b) to apply an amount not to exceed $230,000 from a Capital Reserve Fund held by the Fire District. The period of probable usefulness for said purpose is twenty-five (25) years.
